Yes you can sue a personal injury lawyer. You should get an opinion from another lawyer before starting the claim. Lawyers are far less reluctant than you may think to give an opinion on the work of another lawyer.
I would suggest that you get an opinion from a lawyer who in different town or city from the lawyer you want to sue.
When calling to make that appointment:
- Make sure the lawyer does professional negligence cases
- Make sure the lawyer is not conflicted (that he or she doesn’t know the lawyer you want to sue)
- Find out if there is a charge for this consultation
If you are considering suing your lawyer you should think about whether it would be better for you to make a complaint about the lawyer to the Law Society of Upper Canada or if you lost your case, appealing the decision.
